Listener Participation & Submission Terms

About These Terms

These Listener Participation & Submission Terms apply to individuals who voluntarily submit content to, communicate with, call into, or participate in The Wells of Love with Kit.

This may include Love Notes at The Wells, Give Them Their Flowers, live or recorded calls, interviews, submitted photographs, audio, video, contests or promotions where applicable, and other listener-participation opportunities.

1. Age Requirement

Website submissions and direct on-air participation are intended for individuals 18 years of age or older.

Individuals under age 18 may participate only when The Wells has obtained appropriate permission from a parent or legal guardian. The Wells may require written or electronic parental or guardian consent before permitting participation.

2. Your Content Remains Yours

You retain ownership of original content you submit to The Wells.

Submitting your story, words, photograph, audio, video, message, reflection, or other original material does not transfer ownership of that material to The Wells of Love with Kit or DK2L Media LLC.

Instead, you grant permission for its use according to the permissions you provide.

3. You Control Your Sharing Permissions

Where sharing choices are provided, you may authorize use through one or more designated channels, including:

Radio Show • Website • Social Media • Private Only

Permission for one form of use does not automatically grant permission for another form of use unless you separately agree otherwise.

The Wells will use reasonable efforts to honor the sharing permissions associated with your submission.

4. Identification Preferences

Where available, you may choose to be identified by:

Full Name • First Name Only • Initials • Anonymous

The Wells will use reasonable efforts to honor the identification preference associated with your submission.

Individuals requesting anonymity should avoid including unnecessary identifying information within their story or submission.

5. Private-Only Communications

Selecting Private Only means you are not granting permission for the submission to be intentionally broadcast or published as listener content.

Authorized individuals responsible for operating The Wells may nevertheless need to receive, review, store, or respond to the communication.

6. Editing Selected Submissions

Content selected for authorized use may be edited for length, clarity, grammar, timing, privacy, technical quality, or broadcast suitability.

The Wells will not intentionally alter the fundamental meaning of a listener's submission.

7. Stories Involving Other People

Please respect the privacy and dignity of others when sharing personal experiences.

You represent that material you submit is your own or that you otherwise have the appropriate right or permission to submit it.

The Wells may remove identifying information or decline material when reasonably appropriate to protect privacy or reduce unnecessary harm.

8. Live Call-In Participation

Calling The Wells does not, by itself, constitute consent to appear on air.

Before a caller is intentionally placed on air or recorded for program use, the caller may be informed that the conversation will or may be broadcast, recorded, rebroadcast, edited, distributed, archived, or otherwise used in connection with The Wells.

Consent may be obtained verbally, electronically, or in writing, depending upon the circumstances.

For spontaneous live participation, verbal consent may be recorded before the caller is connected to the program. By affirmatively consenting to participate, the caller authorizes the agreed recording, live broadcast, rebroadcast, distribution, and related use of that participation.

Once statements have actually been transmitted during a live broadcast, they cannot be withdrawn from the original broadcast after they have aired.

9. Recorded Calls, Interviews & Appearances

Participants in prerecorded interviews, extended appearances, special features, or other planned programming may be required to complete an additional appearance or media release.

The Wells may establish additional participation requirements appropriate to the particular program or appearance.

10. Participation & Media Permissions

Certain participation opportunities may require additional permission before a listener's name, voice, photograph, likeness, video, recording, or other identifiable material is used.

The Wells may provide electronic permission forms, recorded verbal consent procedures, guest releases, parental or guardian authorizations, or other appropriate consent methods depending upon the nature of the participation.

Providing permission for one particular appearance, recording, submission, or use does not automatically authorize unrelated future uses unless the participant expressly agrees otherwise.

11. Photographs, Audio, Video & Other Media

If you voluntarily submit photographs, recordings, video, audio, or other media, you represent that you have the right to submit that material.

Where other identifiable individuals appear in submitted media, additional permission may be required before the material is used publicly.

The Wells may decline to use material when appropriate permissions cannot reasonably be established.

12. Future Use of Authorized Content

When you authorize The Wells of Love with Kit to publicly use a submission or participation, your permission may include use of that authorized content in the original program or feature as well as future episodes, rebroadcasts, encore presentations, program archives, website content, social media content, promotional materials, advertisements for The Wells, highlight or retrospective features, and other content promoting or supporting The Wells of Love with Kit and its programming, but only within the scope of the permissions you provided.

For example, if you authorize use on the radio but do not authorize social media use, your submission will not be intentionally republished on social media solely because it was previously used on the radio.

The Wells may also refer back to or discuss previously authorized material in future programming where reasonably related to the original participation, subject to the permissions and identification preferences provided by the participant.

Permission to use submitted content does not authorize The Wells to sell or license a listener's original submission to an unrelated third party for that third party's independent commercial use unless separate permission is obtained.

13. Contests, Giveaways & Promotions

The Wells may occasionally conduct contests, giveaways, promotions, or similar activities.

Individual promotions may have separate Official Rules addressing matters such as eligibility, age, geographic restrictions, entry period, method of entry, winner selection, prizes, prize value, notification, taxes, publicity permissions, and other applicable requirements.

When separate Official Rules are provided, those rules govern that particular promotion in addition to any applicable general terms.

Participation in a general listener feature does not automatically constitute entry into a contest.

14. Selection Is Not Guaranteed

Submission or participation does not guarantee that content will be broadcast, published, discussed, selected, featured, or otherwise used.

The Wells reserves editorial discretion regarding content selected for its programming and platforms.

15. No Compensation Unless Separately Agreed

Unless a separate written agreement provides otherwise, listener participation and submissions are voluntary and do not create an entitlement to payment, royalties, fees, residuals, or other compensation.

16. Sensitive Topics

The Wells may address relationships, grief, healing, abuse, domestic violence, trauma, mental health, family experiences, and other sensitive matters.

Participation in The Wells is not a substitute for medical, mental-health, legal, financial, emergency, or other professional services.

Individuals experiencing an emergency or immediate danger should contact emergency services or an appropriate qualified professional or support organization.

17. Withdrawal Requests

You may request withdrawal of an unused submission by contacting: privacy@thewellsoflove.com

Where reasonably possible, The Wells will honor an appropriate request.

Material that has already been broadcast, published, distributed, downloaded, archived, syndicated, or independently shared by others may not be completely retrievable.

18. Content Standards

The Wells may decline, discontinue, edit where authorized, or remove material that is reasonably considered threatening, unlawful, defamatory, discriminatory, excessively explicit, intentionally misleading, invasive of privacy, or otherwise inconsistent with the standards and character of The Wells.

19. Guest Appearances

Formal invited guests may be subject to a separate Guest Appearance & Media Release.

These Listener Participation & Submission Terms are not intended to replace any additional agreement entered into between The Wells and an invited guest.

20. Privacy

Personal information associated with participation will be handled in accordance with The Wells of Love with Kit Privacy Policy.

21. Changes to These Terms

These terms may be updated as The Wells introduces new programming, technologies, platforms, contests, or participation opportunities.

The effective or last-updated date will be revised when appropriate.
